Definitions In these terms, the following definitions apply:
- Provider: AmsterTram, the party applying these general terms and conditions.
- Customer: Any natural or legal person entering into an agreement with the Provider, whether or not acting in the course of a profession or business.
Article 1: No Right of Withdrawal
1.1 Reservations made with AmsterTram are final. The legal 14-day withdrawal period does not apply.
Article 2: General
2.1 These terms apply to all offers and reservations unless agreed otherwise in writing.
2.2 Reservations are made online at www.AmsterTram.nl. Payment confirms the reservation. A confirmation is sent by email and must be shown upon arrival.
2.3 These terms are made available electronically and can be downloaded. If unavailable, a copy will be provided on request.
2.4 Deviations from these terms must be confirmed in writing.
2.5 If any term is invalid, the rest remain in effect. A replacement will be agreed upon that reflects the original intent.
Article 3: Reservations
3.1 Offers are clearly described. Errors or obvious mistakes are non-binding.
3.2 Offers include:
- Total price including taxes;
- Payment and confirmation process;
- Booking requirements (minimum age: 18).
3.3 AmsterTram reserves the right to refuse or change a reservation and will offer alternatives or refund if needed.
3.4 Confirmations must be checked for accuracy. Errors must be reported within 10 days and before the visit.
Article 4: Personal Data
4.1 Customer data is used for:
- Reservation management;
- Communication regarding changes;
- Optional marketing if the customer consents.
4.2 Customers may opt out via nieuwsbrief@AmsterTram.nl.
4.3 Requests for data access or correction can be sent to info@AmsterTram.nl.
4.4 Media taken during the ride may be used for promotional purposes unless objected to by the customer.
Article 5: Agreement Formation
5.1 The agreement is valid once payment is confirmed.
5.2 The provider ensures secure data transmission and online payments.
5.3 The provider may verify payment ability and reject the reservation with explanation if necessary.
5.4 The provider will send:
- Meeting point information;
- A short version of these terms including withdrawal exclusion.
Article 6: Service Delivery
6.1 The provider performs services professionally.
6.2 Only even-numbered bookings can be made online. For odd numbers, contact is required. An empty seat fee may apply.
6.3 Rides last approx. 2.5 hours. Routes and timing may change without entitlement to compensation.
6.4 Customers must provide required information in a timely manner.
6.5 AmsterTram is not liable for damage caused by incorrect customer data.
Article 7: Pricing
7.1 Prices are fixed unless VAT or legal rates change.
7.2 In case of price changes after booking, the customer may cancel if not agreed.
Article 8: Delays & Cancellations
8.1 Delays by the customer may lead to cancellation without refund.
8.2 AmsterTram may request prepayment.
Article 9: Cancellation Policy
9.1 Cancel or move 10+ days in advance: full refund or voucher (5 euro administration fee).
9.2 Cancel or move 10 to 2 days: voucher or move only plus 5 euro administration fee
9.3 Cancel within 48 hours: no refund, reservation is transferable.
9.4 AmsterTram may cancel due to weather or technical issues and will inform customers as early as possible.
Article 10: Liability
10.1 AmsterTram is not liable for:
- Theft or damage during the ride;
- Tram breakdowns or route disruptions;
- Delays caused by technical issues.
10.2 Customers are liable for damage caused by themselves or their possessions.
Article 11: Governing Law
11.1 Dutch law applies.
11.2 Parties will attempt to resolve disputes amicably before legal action.
Article 12: Gift Cards
12.1 No expiry date. Not redeemable for cash.
12.2 Can only be used once. Misuse will be reported.
Article 13: Group Bookings
13.1 Options can be held for up to 2 weeks.
13.2 A 20% deposit is due 2 months prior or within 5 business days for short-notice bookings.
13.3 Full payment is due 4 weeks prior (or 2 weeks for last-minute bookings).
13.4 Rescheduling:
- Free up to 8 weeks in advance;
- 8 to 1 week: credit voucher;
- 1 week to 72 hours: 50% charge, rest as credit;
- Within 72 hours: full charge.
13.5 Adjustments to group size:
Less than 48 hours: full charge.
Up to 10 days prior: max 10% reduction;
10 days to 48 hours: 30% fee;
