Terms and Conditions

In these terms, the following definitions apply:

Provider: AmsterTram, the party applying these general terms and conditions.
Customer: Any natural or legal person entering into an agreement with the Provider, whether or not acting in the course of a profession or business.

Article 1: No Right of Withdrawal

1.1 Reservations made with AmsterTram are final. The statutory 14-day withdrawal period does not apply.

Article 2: General

2.1 These terms apply to all offers and reservations, unless otherwise agreed in writing.

2.2 Reservations are made online at www.AmsterTram.nl. Payment confirms the reservation. A confirmation is sent by email and must be shown on arrival.

2.3 These terms are available electronically and can be downloaded. If unavailable, a copy will be provided on request.

2.4 Deviations from these terms must be confirmed in writing.

2.5 If any provision is invalid, the remaining provisions remain in force. A replacement provision reflecting the original intent will be agreed.

Article 3: Reservations

3.1 Offers are clearly described. Errors or obvious mistakes are non-binding.

3.2 Offers include:

the total price including taxes;
the payment and confirmation process;
booking requirements (minimum age: 18).
3.3 AmsterTram reserves the right to refuse or amend a reservation and will offer alternatives or a refund where necessary.

3.4 Confirmations must be checked for accuracy. Errors must be reported within 10 days and before the visit.

Article 4: Personal Data

4.1 Customer data is used for:

managing reservations;
communication about changes;
optional marketing if the customer consents.
4.2 Customers can unsubscribe via [email protected].

4.3 Requests to access or correct data can be sent to [email protected].

4.4 Media recorded during the tour may be used for promotional purposes, unless the customer objects.

Article 5: Agreement Formation

5.1 The agreement is valid once payment is confirmed.

5.2 The Provider ensures secure data transmission and online payments.

5.3 The Provider may verify payment capacity and, if necessary, decline the reservation with an explanation.

5.4 When placing the reservation, these terms are presented by way of a link and are accepted by the customer by completing the reservation.

Article 6: Service Delivery

6.1 The Provider performs its services professionally.

6.2 Only bookings for an even number of guests can be made online. For odd numbers, please contact us. Charges may apply for unoccupied seats.

6.3 Dinner tours last approximately 2.5 hours. Routes and times may change without any right to compensation.

6.4 Customers must provide the required information in good time.

6.5 AmsterTram is not liable for damage caused by incorrect customer information.

Article 7: Pricing

7.1 Prices are fixed, unless VAT or statutory rates change.

7.2 In the event of a price change after booking, the customer may cancel if the change has not been agreed.

Article 8: Delays & Cancellations

8.1 Delays caused by the customer may result in cancellation without a refund.

8.2 AmsterTram may require payment in advance.

Article 9: Cancellation Policy

9.1 Cancellation 10 or more days in advance: full refund (less a 5 euro administration fee) or a voucher.

9.2 Cancellation between 10 and 2 days in advance: voucher or rebooking only (5 euro administration fee).

9.3 Cancellation within 48 hours: no refund. Reservations are transferable.

9.4 AmsterTram may cancel a reservation if the tour cannot take place or cannot be carried out in full, including in any event due to weather conditions, a technical defect, force majeure, insufficient participation, or because for any reason whatsoever insufficient capacity proves to be available. AmsterTram will inform the customer as soon as possible.

9.5 In the event of a cancellation under Article 9.4, the customer may choose between rebooking to another available date free of charge, or a full refund of the amount paid within 5 working days. No further compensation is due, except as provided in Article 9.6.

9.6 If insufficient capacity is available for all reservations for the same tour, AmsterTram will cancel in the order in which the agreements were formed, starting with the most recently formed agreement. In that case the customer receives, in addition to the choice under Article 9.5, a voucher to the value of the reservation amount, valid for 24 months.

Article 10: Liability

10.1 AmsterTram is not liable for:

theft of or damage to belongings during the tour;
tram breakdowns or route interruptions;
delays caused by technical problems.
10.2 Customers are liable for damage caused by themselves or their belongings.

Article 11: Governing Law

11.1 Dutch law applies.

11.2 The parties will attempt to resolve disputes amicably before taking legal action.

Article 12: Gift Cards

12.1 No expiry date. Not redeemable for cash.

12.2 Can be used only once. Misuse will be reported.

Article 13: Group Bookings

13.1 Options can be held for a maximum of 2 weeks.

13.2 A deposit of 20% is due 2 months in advance, or within 5 working days for short-notice bookings.

13.3 Full payment is due 4 weeks in advance (or 2 weeks for last-minute bookings).

13.4 Rescheduling:

free of charge up to 8 weeks in advance;
8 to 2 weeks: voucher;
2 weeks to 72 hours: 50% charge, the remainder as a voucher;
within 72 hours: no refund, full charge.

13.5 Changes to group size:
less than 48 hours: no changes possible;
up to 10 days in advance: maximum 10% change;
10 days to 48 hours: 30% of the cost is charged for a change.
